If you access our website or join our classes/coaching from outside of the United States, you do so at your own risk and are solely responsible for ensuring compliance with your local laws.
2. Guidelines for Conduct & Participation
To keep our coaching environment and classes safe and productive, you agree to abide by the following community guidelines. You agree that you will not:
Engage in behavior that is harassing, demeaning, threatening, defamatory, abusive, vulgar, or constitutes hate speech during live coaching sessions or classes.
Disrupt the learning environment for other students or participants in a class setting.
Share addresses, access links, passwords, or entry codes to private coaching sessions or classes with unauthorized third parties.
Deploy automated programs (like bots or scrapers) to harvest information from this Site.
We reserve the right to remove you from a class or terminate your coaching services immediately, without a refund, if you violate these guidelines.
3. Booking, Attendance, & Cancellations (Acuity Scheduling)
All coaching sessions, consultations, and class registrations are managed securely via Acuity Scheduling.
Cancellation & Rescheduling: If you need to cancel or reschedule a one-on-one coaching session, you must do so at least 24 hours prior to your scheduled time.
Missed Sessions: Cancellations made outside of this window, or missed sessions ("no-shows"), will result in the forfeiture of that session fee.
Class Attendance: Live classes are scheduled for specific dates and times. If you miss a live class, we are not responsible for providing a make-up session.
4. Fees & Payment Processing (Stripe)
All fees for coaching packages, individual sessions, and classes are processed securely through Stripe. You authorize Stripe and us to charge your designated payment method.
You are responsible for providing accurate and up-to-date billing information. If a recurring payment or payment plan installment is declined, you agree to pay the outstanding balance upon demand.
5. Communications (Mailchimp)
By booking a session, enrolling in a class, or opting into a form on this Site, your email will be managed via Mailchimp so we can send you scheduling updates, class links, and relevant business announcements. You can opt out of marketing communications at any time via the "unsubscribe" link.
6. Intellectual Property & Class Materials
All concepts, training methods, worksheets, spoken lecture materials, videos, and graphics presented during coaching sessions or classes are owned by Kyle Branzel.
Enrolling in a class or coaching program grants you a single, non-transferable right to view and use these materials for your personal, educational growth.
You may not record live sessions without permission, nor may you resell, distribute, share, or publicly display any proprietary materials or recordings provided to you.
7. No Refunds
Due to the live, time-blocking nature of coaching services and classes, all sales are final. We do not offer refunds for completed sessions, active coaching packages, or enrolled classes under any circumstances.
8. Disclaimer & No Guarantees
You acknowledge that coaching and educational classes require personal effort and implementation. We do not make any guarantees regarding specific outcomes, financial gains, career advancements, or personal results from your participation in our Services. Any testimonials or examples shown on this Site are illustrative and do not guarantee that you will achieve the same results.
9. In-Person Sessions & Assumption of Physical Risk
By booking and attending an in-person coaching session, class, or consultation at our private home studio or any rented external rehearsal/studio space, you explicitly acknowledge and agree to the following:
Assumption of Risk: You understand that attending in-person sessions carries inherent risks, including but not limited to physical movement, vocal strain, or accidental slips, trips, and falls. You voluntarily assume all risks related to your physical presence at the venue.
Liability Waiver: To the maximum extent permitted by law, you release, waive, and forever discharge Kyle Branzel, his business, and any rented studio entities from any and all liability, claims, demands, or causes of action arising out of any physical injury, illness, personal property damage, or theft occurring during, before, or after your session on the premises.
Rented Studio Spaces: When sessions are held at a rented third-party rehearsal studio, you agree to abide by all rules, safety guidelines, and policies established by that venue. You agree that Kyle Branzel is not responsible for the maintenance, security, or structural safety of third-party rented properties.
Damage to Property: You agree to be held financially responsible for any intentional or negligent damage you cause to the equipment, instruments, or structural property of the home studio or rented rehearsal space.
10. Limitation of Liability
To the fullest extent permissible by law, Kyle Branzel shall not be liable for any indirect, incidental, or consequential damages resulting from your participation in our coaching or classes. Furthermore, we are not legally responsible for temporary disruptions, downtime, or technical failures of our third-party platforms (Stripe, Acuity Scheduling, Mailchimp).
11. Governing Law & Venue
This Agreement shall be governed by the laws of the State of New York, United States of America. Any legal actions or proceedings arising out of this Agreement will be brought solely in the state or federal courts located in the State of New York.
12. Class Action Waiver
YOU AGREE TO WAIVE THE RIGHT TO LITIGATE IN COURT OR ARBITRATE ANY DISPUTE AS A CLASS ACTION. YOU AGREE THAT YOU WILL ONLY MAKE CLAIMS AGAINST US IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS PROCEEDING.
